Who Can Apply?
Individuals or companies, including foreign applicants can apply (who must appoint a local representative through a Power of Attorney).
Types of Applications in Bangladesh:
(a) Ordinary Trademark Application-Filed to protect a mark in Bangladesh only.
(b) Convention Priority Application-Filed under the Paris Convention, allowing an applicant to claim priority based on an earlier application in another member country (must be filed within 6 months of the original filing).
Requirements:
Name, address, and Nationality of the applicant (individual or company) (If individual, the National ID card of the Applicant with certified English translation is required);
If the applicant is a company, the country of incorporation (scan copy of the Incorporation certificate with certified English translation is required);
Trademark Name/Logo-A clear representation of the mark (if a logo, soft copy with the meaning of the logo).
Class of Goods/Services-Bangladesh follows the Nice Classification (NCL, 12th Edition).
Description of Goods/Services-A detailed list of items covered under the trademark.
Priority Application Number and Date-If claiming priority under the Paris Convention, the application must be filed within 6 months of the priority date.
Certified Copy of Priority Application-Required if priority is claimed (hard copy can be filed later).
A scanned copy of the signed & sealed Power of Attorney (POA) is required if the application is filed through us.
If the mark contains with letters other than English then the translation and transliteration of the mark.
Information as to whether the goods/services are already being used in Bangladesh or not, if being used the exact date of first use.
Information as to whether the applicant is the manufacturer/service provider? if not then whether the applicant is the exporter or buys all products of the brand owner?
Conduct Availability Search (optional):
A search can be made in prescribed manner before filing the application to find out the availability if there is a similar or same pending or registered mark.
STAGES:
EXAMINATION
Upon filling the application online, the Registrar of DPDT, Bangladesh examines the application for distinctiveness, potential conflicts, and deceptiveness. If there is no objection, then the application proceeds to publication stage. However, if the office raise any objections or requires any clarification/further documents then, an official letter is issued. Applicants must respond within 60 days. If the mark is accepted, the mark proceeds to publication.
PUBLICATION
Applications that passes the examination stage successfully, receives a notice of payment of publication fees in prescribed form. Upon receiving the publication fee, the mark will be published in the Government Journal to invite public opposition.
OPPOSITION (if any)
Any party can oppose the published Trademark within 2 months of publication. If no opposition arises or it’s resolved through reply or hearing in the applicant’s favour, the mark qualify for registration.
REGISTRATION
The Applicant at this stage can obtain the registration certificate upon paying the prescribed registration fees. Once registered, the trademark is valid for 7 years from the date of filing or priority date and may then be renewed for a period of 10-years, and also at the expiration of each period of 10 years, thereafter.
POST-REGISTRATION: RENEWAL
After the initial 7 years, renewals ensure ongoing protection for 10-year periods, safeguarding your brand’s exclusivity. Application for renewal of a trademark may be made to the Registrar in the prescribed manner, not more than six (6) months before the expiration of the registration or last renewal. Renewal is valid for Ten (10) years. A Certificate of Renewal is issued by the Registrar.
Renewal in grace period with delay fee and/or renewal upon restoration of an abandoned registered trademark with delay fee and restoration fee is possible.
